Terms and Conditions
1. The Promoter is Cowboys Rugby League Football Limited, the Hutchinson Builders Centre, 26 Graham Murray Place, Railway Estate QLD 4810. ABN: 28 060 382 961.
2. In these terms and conditions, we will refer to the North Queensland Toyota Cowboys as ‘the Promoter’, ‘Cowboys’, ‘us’, ‘we', ‘our’. We will refer to an entrant as ‘Member’, ‘entrant’, ‘you’ and ‘your’.
3. Information on how to enter the Competition and the Prize form part of these Terms and Conditions; participation in the Competition constitutes acceptance of these Terms and Conditions by the entrant. By entering this competition, you acknowledge and agree that you have read and understood these terms and conditions and will comply.
4. These Terms and Conditions should be read in conjunction with the Terms and Conditions applicable to the 2024 Cowboys Membership purchased as a gift.
5. Nothing in these term and conditions amends, limits or excludes any rights or remedies that an entrant may have under the Australian Consumer Law which cannot lawfully be amended, limited or excluded.
COMPETITION DATES
6. The Promotion commences 9.00am Wednesday 6 December 2023 and closes at 1.00pm, Wednesday 13 December 2023.
7. The prize will be drawn and the winners contacted by the Promoter by phone during business hours on Wednesday 13 December 2023.
ELIGIBILITY
8. Directors, officers, management and employees of the Promoter (and their immediate families), or agencies or companies associated with or connected to the provision of the Competition in any way, are ineligible to enter.
9. Entry is open to both members and non-members of the North Queensland Toyota Cowboys.
10. Any member or previous member with an account in financial arrears is not eligible.
11. The prize will be made available for collection from Wednesday, 13 December 2023 from the Cowboys corporate office at the Hutchinson Builders Centre, 26 Graham Murray Place, Townsville QLD. The prize cannot be posted.
PRIZE
12. One winner will be randomly chosen from all customers who purchase a gift membership from the Cowboys membership pop up or via cowboys.com.au/gifting
13. The prize consists of:
- a 2023 signed NRL squad jersey
- a Kickass dual zone fridge freezer
- a 2024 training visor
- a Cowboys penant flag
- a 2022/23 season football
- two stubby coolers
- Cowboys earphones
14. Any travel, accommodation or out-of-pocket costs accrued by the winner to participate in the promotion or collect the prize will be at their own expense.
15. The prize cannot be exchanged for cash or credit.
16. The prize is non-transferable.
METHOD OF ENTRY
17. There is no entry fee to enter the competition.
18. One entry is provided for every one eligible gift membership purchased.
19. To enter, the entrant must purchase a gift membership by 1.00pm, Wednesday 13 December 2023.
20. Entries are deemed to be submitted at the time they are received by the Promoter's database.
21. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, technical disruptions, network congestion, communications failure or otherwise.
22. The Promoter is not liable for any consequences of user error including, without limitation, costs incurred.
23. The Promoter prohibits entries that violate the rights of others or are unlawful, defamatory, or obscene; the Promoter reserves the authority to reject entries which violate these standards.
MARKETING PERMISSIONS
24. Entrants must agree to have their name, phone number and email address added to the North Queensland Toyota Cowboys marketing subscriptions list to be eligible to enter.
25. Subscribers can unsubscribe from the Cowboys marketing subscriptions list at any time via the Cowboys preference centre or contacting us on 1300 462 692.
26. By entering this competition, entrants give consent to Cowboys Rugby League Football Limited, its affiliates and agents, to use your image and likeness and/or any interview statements in our publications, advertising or other media activities (including the Internet), without compensation or other remuneration, now or in the future.
27. If any part of a Prize is unavailable, for any reason (including unforeseeable or other special circumstances), the Promoter, in its absolute and sole discretion, reserves the right to substitute the Prize or any part of the Prize for a prize of equal value and/or specification.
28. To the extent permitted by law the Promoter makes no representations or warranties as to the suitability of the Prize and no compensation will be payable if, for any reason, the Winner is unable to use the Prize as stated.
29. If there is a dispute as to claiming the Prize, the Promoter reserves the right in its sole discretion, to determine the outcome of the dispute.
30. We may cancel one or all of the competition inclusions if an event outside our reasonable control occurs that impacts or may impact on the relevant inclusion including, but not limited to, fire, storm, flood, tsunami, earthquake, explosion, war, invasion, rebellion, sabotage, epidemic, pandemic (including the Covid-19 pandemic), government intervention or orders (whether mandatory or recommended), labour dispute, labour shortage, failure or delay in transportation and act or omission of any third person (including the NRL, subcontractors, customers, governments or government agencies) (each such event a “Force Majeure Event”).
31. If a Force Majeure Event occurs that affects the competition inclusions, or the ability for the competition to be held, we will use reasonable endeavours to notify you. However, where the event is sudden or last-minute, this may not be possible. While we do not offer compensation for any costs incurred by entrants to participate in the competition if it is cancelled in whole or in part due to Force Majeure Events.
