TERMS & CONDITIONS

The promoter is Cowboys Rugby League Football Limited, the Hutchinson Builders Centre, 26 Graham Murray Place, Railway Estate QLD 4810. ABN: 28 060 382 961 (North Queensland Toyota Cowboys).

These terms and conditions apply to the offer: ‘Back us for 2024 and we’ll back you with a free double-pass to Cowboys v Broncos 2023.’

In these terms and conditions, we will refer to the North Queensland Toyota Cowboys as ‘us’, ‘we', ‘our’ and ‘Cowboys’. We will refer to a new 2024 full season member in these terms and conditions as ‘a member’, ‘you’ and ‘your’.

By joining as a new 2024 full season member to access this offer, you acknowledge and agree that you have read, understood and will comply with these terms and conditions, as well as the general terms and conditions applicable to all 2024 full season memberships, at: www.cowboys.com.au/membership/terms-and-conditions/.

All prices set out in these terms and conditions are GST-inclusive.

Nothing in these terms and conditions amends, limits or excludes any rights or remedies that you may have under applicable law (including the Australian Consumer Law) which cannot lawfully be amended, limited or excluded.

OFFER

1. Under this offer, and in accordance with these terms, if you join as a new 2024 Gold Star or Platinum Star Cowboys full season member (Single 2024 Membership), you will receive one (1) double-pass to the NRL and NRLW Cowboys v Broncos Double Header at Queensland Country Bank Stadium on 5 August 2023 (Cowboys v Broncos Match).

2. To join and receive the offer, you must pay a $60 deposit for every new single full season 2024 membership (regardless of whether your eventual membership/s are for an adult, concession, child or packaged as part of a family or group). 

3. You will not be able to choose your seats, membership tier (i.e. adult, concession, child or family) or payment arrangement (in full or monthly instalments) at the time of paying your deposit. We will contact you before 5.00 pm AEST, Monday 11 September 2023 to finalise your seats, tier and payment arrangement.

4. This limited time offer is available while stocks last. The offer period will commence on 11.30 am AEST, Friday 2 June 2023 and will end on the first to occur of:

a. 3.00pm AEST, Thursday 3 August 2023;

b. allocation of all available double-passes to the Cowboys v Broncos Match; or

c. for any reason, at any time, at our discretion.

5. A double-pass consists of two reserved seats in the upper bay of the Southern Grandstand for the Cowboys v Broncos Match, valued at approximately $60.00 (incl GST). 

6. A double-pass may be used to admit an adult, concession or child.

7. A double-pass may only be used for seats in the upper bay of the Southern Grandstand, which are not suitable for patrons with Accessibility or PWD requirements.

8. If you purchase multiple 2024 Memberships under this offer, we can’t guarantee all double-pass seats for Cowboys v Broncos on 5 August 2023 which you are eligible to receive, will be seated together.

9. The double-passes awarded under this offer cannot be redeemed for cash, and we accept no responsibility for any variation in the value of the double-passes. 

10. If a double-pass is unavailable for any reason, we may substitute it for another item of equal or higher value as determined by us.

ELIGIBILITY

11. This offer is applicable to new 2024 Gold or Platinum full season memberships only and does not apply to renewals.

12. This offer can only be redeemed by persons aged 18 years and older.

13. This offer is open to members who pay with a credit or debit card only. Cash or cheque not accepted.

14. The North Queensland Toyota Cowboys may, in its sole discretion, disqualify all claims from, and prohibit further participation in this promotion by, any person who tampers with or benefits from any tampering with the claim process or with the operation of the promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person.  Our decision is final, and no correspondence will be entered into.

LIMITATIONS

15. You and your companion(s) are responsible for making your own way to and from the Cowboys v Broncos Match.  All ancillary costs associated with the Cowboys v Broncos Match, including but not limited to any travel, accommodation, and meal costs incurred, are your responsibility.

16. We are not liable to you if you are unable to attend the Cowboys v Broncos Match for any reason.

17. We accept no responsibility for any disputes arising between you and any person who you choose to, or choose not to, share a double-pass with.

LIABILITY

18. The North Queensland Toyota Cowboys and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the double-passes, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).  Nothing in these conditions of entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

19. The North Queensland Toyota Cowboys is not liable for any tax implications for you arising from receiving the double-passes provided under this offer.  Independent financial advice should be sought.  Where this promotion involves, for GST purposes, supplies being made for non-monetary consideration, claimants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

CANCELLATION OF 2024 MEMBERSHIP

20. You may cancel your 2024 Membership by 3.00 pm AEST, Thursday 3 August 2023 by calling the Cowboys Membership team on 1300 462 692 (opt 1). However, if you do cancel:

a. you will forfeit all deposits paid towards all 2024 Memberships; and

b. your tickets to the Cowboys v Broncos Match will be cancelled.

21. After 3.00 pm AEST, Thursday 3 August 2023, a refund will not be permitted for change of mind or for changes in personal circumstances. Where a member has a right to a refund under the Australian Consumer Law, a refund will be provided.

FULL SEASON MEMBERSHIP TERMS AND CONDITIONS

22. The offer requires you to purchase a new full season 2024 Gold or Platinum membership for which the general terms and conditions, including information about our annual Rollover (auto renewal) process,  can be found here: www.cowboys.com.au/termsandconditions.

23. If you purchase 2024 Full Season membership under this offer, you will:

a. receive access to your membership discounts, offers and inclusions from 1 November 2023;

b. receive your membership card and merchandise pack in early 2024; and

c. receive access to purchase the members exclusive polo when it becomes available in the Cowboys Team Shop in early 2024.

PAYMENT

24. To access the offer, for every new single Full Season membership you will be required to pay a $60 deposit using a credit or debit card, which we will record in your membership account.

25. At the time of placing your deposit/s, you will only be able to select between ‘Gold Star – Northern’, ‘Gold Star – Southern’ or ‘Platinum Star - Eastern’ during the purchase process. You will not be able to finalise your specific seats or membership at that time.

26. Once your deposit/s have been paid, we’ll contact you by phone or email before 4.00 pm AEST, Monday 11 September 2023 to confirm the details of your 2024 Membership, including your seat selection(s) for the 2024 season.

27. When we contact you, we will ask you to select your seats and membership category for the 2024 season from the following promotional pricing:  

 28. When we contact you to select your seats, we will confirm:

a. your seats for the 2024 season

b. the total cost of your 2024 membership, less any deposits paid; and

c. how you wish to pay your 2024 Membership fees a (either in full or in ten instalments paid monthly over 10 months.

29. If we are unable to contact you (despite attempting to do so) 4.00 pm AEST, Monday 11 September 2023  we will, on your behalf:

a. select the best seats available in your membership category;

b. select ‘in full’ as your preference for payment; and

c. email you with confirmation of the above.  

30. On Wednesday 20 September 2023, based on your payment preference, we will EITHER:

a. deduct your 2024 Membership fees in full, less any deposits paid; OR

b. deduct the first of your 10 instalment payments, calculated from your total membership fees less any deposits paid.

31. Once payment has been received for your 2024 Membership, you will be entered into the club’s Rolling Renewal process for the 2024/2025 season.

COMMUNICATION AND PRIVACY

32. It is a condition of financial membership that members give consent to the North Queensland Toyota Cowboys, its affiliates and agents, to use their image and likeness and/or any interview statements from members in its publications, advertising or other media activities (including the Internet), without compensation or other remuneration, now or in the future.  By signing up for a membership, you provide this consent, and you represent that any others on whose behalf you are obtaining a membership (e.g. family members) also give the same consent.

33. By participating in this offer, you agree to have your email address added to the North Queensland Toyota Cowboys' email lists. You are able to unsubscribe at any time by visiting our preference centre at the bottom of every North Queensland Toyota Cowboys email.

34. We will need to collect personal information from you (such as your name, age and contact details). In providing this information to us, you agree to the terms of our privacy policy, which you can view here: Privacy Policy.

35. We have suggested including a broader reference to applicable law here in case other laws, such as state or territory consumer laws, also apply and cannot be excluded.
