Gift memberships 2023/24 season 

TERMS & CONDITIONS:

These Terms & Conditions apply to gift memberships purchased for use in the 2024 season.

In these Terms & Conditions, we will refer to the North Queensland Toyota Cowboys as ‘us’, ‘we and ‘our’.

In these Terms & Conditions we will refer to a customer who purchases a gift membership as a ‘purchaser’, ‘you’ and ‘your’.

In these Terms & Conditions we will refer to the recipient of the gift membership as a ‘recipient’, ‘member’, ‘them’ and ‘their’.

These Terms & Conditions should be read in conjunction with the terms and conditions relevant to the membership product that is being purchased as a gift, which are available to read at cowboys.com.au/termsandconditions.

By purchasing a gift membership, the purchaser acknowledges and agrees that you have read, understood and will comply with these Terms & Conditions and the Terms & Conditions relating to the membership product being purchased.

Nothing in these Term & Conditions amends, limits or excludes any rights or remedies that a consumer may have under the Australian Consumer Law which cannot lawfully be amended, limited or excluded.

Please read these Terms & Conditions prior to purchasing a gift membership for the 2024 season.

Permitted use

1. Consumer memberships may only be used for non-commercial (personal) purposes by the purchaser.

2. Membership gift vouchers may only be used for non-commercial (personal) purposes by the purchaser, and once redeemed, by the recipient.

3. Use of Consumer membership products for any commercial purpose is prohibited; a commercial purpose is any activity with the intent to gain commercial advantage of any kind, including marketing promotions (including prizes), market research, consumer data collection, stakeholder or community engagement, educational purposes or awareness campaigns.

4. Re-sale of Consumer membership products for commercial purposes, either in full, or separated into match tickets or member benefits (i.e. Cowboys Team Shop voucher), is strictly prohibited.

5. Any person found to be using a Consumer membership for a commercial purpose, or having granted a third party to use their membership for a commercial purpose, will have their membership immediately cancelled without offering a refund, and any future applications for membership refused.

Definition of gift membership

6. A ‘Cowboys gift membership’ refers to a membership gift voucher which can be redeemed for the 2024 Cowboys membership product stated on the voucher.

7. A Cowboys gift membership provides the recipient with membership to the North Queensland Toyota Cowboys for our Club’s ‘financial year’, which is 1 November 2023 to 31 October 2024 for the 2024 season. As a member, the recipient can enjoy applicable membership benefits (such as discounts on merchandise) during the whole of the club’s financial year for the membership (not just during the NRL playing season).

8. To purchase a membership gift voucher, you must purchase a membership gift product via cowboys.com.au/gifting or by calling the Cowboys Membership team on 1300 462 692 (opt 1) or membership@cowboys.com.au.

9. As the purchaser, you must use your personal details to purchase a membership gift voucher, and not the personal details of the recipient.

10. A Cowboys membership purchased directly in someone’s name, with or without their consent, is not considered a gift membership.

11. Once the recipient has been presented with the membership gift voucher, they must contact the Cowboys Membership Team on 1300 462 692 (opt 1) or membership@cowboys.com.au to redeem the voucher and provide consent for us to use their personal details for their membership.

12. If the recipient fails to contact the Cowboys Membership team to redeem their membership gift voucher by the end of the club’s financial year (4.00pm, Thursday 31 October 2024), the membership will be finalised in name of the purchaser, who will be noted in our records as the ‘2024 member’ for that account.

Distribution of membership pack

13. 2024 Cowboys members are entitled to a member’s merchandise pack, with varying inclusions depending on their membership category. To confirm the inclusions within the merchandise pack of a specific membership product, visit www.cowboys.com.au/membership/benefits/

14. If you purchase a gift membership, the recipient’s members merchandise pack will not be dispatched until they contact the Cowboys Membership team to redeem the voucher and provide consent for us to use their personal details for their membership.

15. If the recipient fails to contact the Cowboys Membership team by 4.00pm, Thursday 31 October 2024 to redeem their membership gift voucher, the membership pack will be dispatched directly to the purchaser.  

16. Members merchandise packs are subject to availability. If stock levels of members merchandise packs are exhausted, a $30 Cowboys Team Shop voucher will be provided as an alternative inclusion.

17. As the purchaser of the product, you may elect to have the members merchandise pack dispatched directly to you, rather than to the gift membership recipient. To arrange this, you must contact the Cowboys Membership team on 1300 462 692 (opt 1) or membership@cowboys.com.au  to advise us and provide consent for your details to be noted in our records as having received a member’s merchandise pack on behalf of the gift membership recipient.

18. We accept no responsibility for any disputes arising between you and the gift recipient relating to the distribution of the members merchandise pack.  

19. Gift memberships purchased any time after the start of the club’s financial year on 1 November 2023 will not be priced on a pro-rata basis and will be charged at the full price published at cowboys.com.au/gifting unless otherwise offered by us.

Privacy and communication

20. The Cowboys’ primary means of communication is email however we may also need to contact you by phone or other methods about matters relating to your purchase. You must inform us of any changes to your contact details and make sure your contact details are complete and correct.

21. You can unsubscribe from Cowboys promotional emails at any time by visiting the preference centre or following the unsubscribe link at the bottom of every Cowboys email.

22. We will need to collect personal information from you (such as your name, age and contact details) to register the gift membership until the recipient contacts us to redeem their voucher. In providing this information to us, you agree to the terms of our privacy policy, which you can view here: Privacy Policy
